By accessing or using services provided by GrowthAgents AI, Inc. ("Company," "we," "us," "our"), including GrowthAgents.ai (the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our Services. These Terms constitute a legally binding agreement between you ("User," "you," "your") and GrowthAgents AI, Inc..

To access our Services, you must create an account providing accurate, complete, and current information. You agree to update your information to maintain accuracy.
You are responsible for maintaining the confidentiality of your login credentials, all activities that occur under your account, and notifying us immediately of any unauthorized access. We are not liable for losses arising from unauthorized use of your account.

Our Services are designed for professional services firms including law firms, accounting firms, and medical practices. You acknowledge and agree that:

The Services, including all software, algorithms, designs, trademarks, and documentation, are owned by GrowthAgents AI, Inc., and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services during your subscription.
You retain ownership of content you input into our Services ("Input Content"). By using our Services, you grant us a limited license to process your Input Content solely to provide the Services.
Our Services integrate with third-party platforms including LinkedIn and Google Business Profile (social posting); Google Analytics and Google Search Console (measurement); WordPress (publishing); Stripe (payments); AWS, Supabase, and Vercel (hosting and data infrastructure); Resend (email delivery); and Anthropic, OpenAI, and Perplexity (AI capabilities). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for third-party service availability, changes, or data-handling practices.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO warranties of merchantability, fitness for a particular purpose, or non-infringement; warranties that the Services will be uninterrupted, secure, or error-free; warranties regarding the accuracy or reliability of AI-generated content; and warranties that the Services will meet your specific requirements.
AI-generated content may contain errors, inaccuracies, or outdated information. You are solely responsible for reviewing and verifying all content before publication.
GrowthAgents does not guarantee, promise, or warrant any particular marketing outcome, including without limitation search rankings, AI-engine citations, website traffic, leads, consultations, client engagements, signed matters, or revenue. Marketing results depend on factors outside our control, including search and AI platform behavior, competition, your market, and your own business operations. Any metrics, examples, or illustrations shown on our website or in our materials are illustrative and are not a promise of results for your business. If anyone selling on our behalf promises you a specific result, they are wrong to do so, and no such promise binds GrowthAgents.
All subscription plans are month to month unless expressly agreed otherwise in writing. You may cancel at any time through your account dashboard, effective at the end of the then-current billing period. Cancellation does not require a phone call or written justification.
If you are not satisfied with the Services, your first thirty (30) days of paid service are covered by our money-back guarantee: cancel your subscription and request a refund by emailing hello@growthagents.ai within fourteen (14) days of cancellation, and we will refund the subscription fees paid for that initial 30-day period. This guarantee applies once per customer, to your first subscription term only, and covers subscription fees only (not one-time setup or on-demand add-on purchases). It is a satisfaction guarantee regarding our Services, not a guarantee of marketing results (see Section 9.1). When you claim the money-back guarantee, we will invite you to a short feedback call with our founder so we can understand what did not work. Participation is voluntary and declining the call does not affect your refund eligibility. Where a call is recorded, we will tell you at the start of the call and obtain your consent before recording, consistent with applicable call-recording laws (including two-party consent laws such as California's). Recordings are used for product improvement only and are handled in accordance with our Privacy Policy.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: GrowthAgents shall not be liable for any indirect, incidental, special, consequential, or punitive damages; our total liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim; we are not liable for damages arising from your use or inability to use the Services; and we are not liable for content published through connected third-party platforms.
Some jurisdictions do not allow the limitation of certain damages, so some limitations may not apply to you.
You agree to indemnify, defend, and hold harmless GrowthAgents AI, Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, content you publish using our Services, your violation of any third-party rights, or your violation of applicable laws or professional ethics rules.
Before filing any formal dispute, you agree to contact us at legal@growthagents.ai to attempt informal resolution for at least 30 days.
Any disputes not resolved informally shall be resolved through binding arbitration in Wilmington, Delaware under the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.
You agree to resolve disputes on an individual basis only and waive any right to participate in class action lawsuits or class-wide arbitration.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. You consent to the exclusive jurisdiction of state and federal courts located in the State of Delaware.
Either party may terminate this agreement at any time. Upon termination, your access to the Services will be revoked immediately; you remain responsible for any outstanding fees; and provisions that should survive termination (including IP rights, disclaimers, and limitations of liability) will remain in effect. We may terminate or suspend your account immediately for violation of these Terms.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email and/or prominent notice at least 30 days before taking effect. Continued use of Services after changes constitutes acceptance of the modified Terms.
